1. Acceptance of Terms

By creating an account on TavernPost, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you may not use the platform.

2. Eligibility and Age Requirements

You must be at least 13 years of age to create an account on TavernPost. Users under the age of 18 may browse and use the platform but may not engage in financial transactions, including purchasing listings, selling content, or participating in commissions. By using TavernPost, you represent that you meet these age requirements.

3. Platform Role and Liability

TavernPost LLC acts solely as a platform intermediary facilitating transactions between independent creators and buyers. TavernPost makes no representations or warranties regarding the quality, accuracy, legality, or fitness for purpose of any commissioned work, listed content, or user-generated material on the platform.

TavernPost bears no liability for the outcome of any transaction conducted through the platform.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify TavernPost immediately of any unauthorized use of your account by contacting support@tavernpost.org.

5. Content and Conduct

Users are solely responsible for the content they upload, publish, or transmit through the platform. The following types of content are prohibited:

• Content that infringes on the intellectual property rights of others
• Illegal material or content that violates any applicable laws
• Sexually explicit or pornographic material
• Content that promotes hatred, violence, or discrimination
• Malware, viruses, or other harmful code
• Spam, phishing, or deceptive content
• Content that impersonates another person or entity

TavernPost reserves the right to remove content and suspend or terminate accounts that violate these terms or the platform's community guidelines.

6. Intellectual Property

Creators retain full ownership of their original work. By listing content on TavernPost, creators grant TavernPost a non-exclusive, worldwide, royalty-free license to display, promote, and distribute the content as necessary to operate the platform and market the creator's work.

If you believe your intellectual property has been infringed upon, you may submit a DMCA takedown notice by contacting support@tavernpost.org with a description of the copyrighted work, the location of the infringing material on TavernPost, and your contact information. TavernPost will respond to valid DMCA requests in accordance with applicable law.

7. Prohibited Uses

You may not use TavernPost to:

• Violate any applicable local, state, national, or international law
• Harass, abuse, or threaten other users
• Attempt to gain unauthorized access to the platform or other users' accounts
• Interfere with or disrupt the platform's infrastructure
• Scrape, crawl, or use automated means to access the platform without permission
• Circumvent or manipulate the platform's fee structure or payment systems
• Create multiple accounts to evade suspensions or bans

8. Transactions and Payments

All financial transactions on TavernPost are processed through Stripe. TavernPost charges a 15% platform fee on all sales and commission payments. Creators receive payouts via Stripe Connect according to Stripe's standard payout schedule.

Commission transactions are governed by the Commission Policy, which outlines deposit terms, delivery expectations, and rework procedures.

9. Geographic Availability

TavernPost is available globally in all countries and regions where Stripe is supported. Users are responsible for complying with any local laws or regulations that apply to their use of the platform and any transactions they conduct through it.

10. Limitation of Liability

To the maximum extent permitted by law, TavernPost LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to loss of profits, data, or other intangible losses. TavernPost's total liability to you for any claim arising from your use of the platform shall not exceed the amount you have paid to TavernPost in the twelve months preceding the claim.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in the Commonwealth of Virginia.

12. Modifications

TavernPost reserves the right to modify these Terms of Service at any time. Users will be notified of material changes via email or through a notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
